Orthopaedic Mobility Rental, LLC – Rental Terms & Conditions

1. Cancellation Policy
-
If the equipment has not been delivered, the rental may be cancelled.
-
Once the equipment has been delivered, no refunds will be issued for the following items:
Power Wheelchair, Kick Scooter, Knee Walker, Mobility Scooter, Manual Wheelchair, Crutches, and Rollator. -
Extension Rate: $25.00 per additional week for Knee Walkers, Manual Wheelchairs, Crutches, and Rollators.

The renter understands there will be no proration, credits, or cash back for early returns.

2. Equipment Protection Plan (Optional)

Protect your rental from accidental damage, loss, or theft during your rental period.

✅ Covers: Minor part replacements, or theft (with a police report filed within 48 hours).
⚙️ Deductible: -
Scooters & Power Chairs – $250 per incident
-
Manual/Transport Wheelchairs, Walkers, Knee Scooters – $50 per incident
-
If you decline this plan, you will be fully responsible for all repair, loss, or replacement costs during your rental period.

3. Cancellation Protection Plan (Optional)
-
This plan allows you to cancel your reservation up to 24 hours before delivery and receive a full refund, minus the processing fee.

If you decline this plan, and you cancel after delivery or within 24 hours of the scheduled delivery time, the rental is non-refundable.

4. Use of Equipment
-
The term “medical device” refers to all rented equipment, including Power Wheelchairs, Knee Walkers, Mobility Scooters, Manual Wheelchairs, Crutches, Kick Scooters, and Rollators.

The renter agrees to:

Use the device carefully and properly, following all instructions provided by Orthopaedic Mobility Rental, LLC.
-
Not loan, sublease, or transfer the equipment to any other person.
-
Use the device exclusively for the renter named on this agreement.
-
5. Condition and Repairs
-
The renter acknowledges that the device has been inspected and is received in good and acceptable condition.
The renter agrees to return the equipment in the same condition, normal wear and tear excepted. -
If the equipment is lost, stolen, or damaged beyond repair, the renter will pay the full replacement cost of the device.

6. Ownership
-
All rental equipment remains the exclusive property of Orthopaedic Mobility Rental, LLC.

7. Severability
-
If any part of this agreement is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.
If limiting a provision would make it valid, it will be interpreted to the extent necessary to make it enforceable. -
8. Assignment
-
This agreement and the rights under it may not be assigned or transferred by the renter without prior written consent from Orthopaedic Mobility Rental, LLC.

9. Binding Effect
-
All terms of this agreement shall apply to and bind both parties, including their heirs, legal representatives, successors, and permitted assigns.

10. Governing Law
-
This agreement shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia.

11. Entire Agreement
-
This document constitutes the entire agreement between the parties and supersedes all prior understandings or representations, whether oral or written.
Any modification must be made in writing and signed by both Orthopaedic Mobility Rental, LLC and the renter. -
12. Waiver
-
Failure by either party to enforce any provision of this agreement shall not constitute a waiver of future enforcement rights.
The acceptance of payment by Orthopaedic Mobility Rental, LLC does not waive its right to enforce any provision of this agreement. -
13. Limited Liability
-
The renter is responsible for operating the equipment safely and according to instructions.
Orthopaedic Mobility Rental, LLC shall not be held liable for any damages, injuries, losses, claims, or deaths arising from or related to the use, misuse, or possession of the equipment, or from the acts or omissions of any person using it. -
